The instant bail applications have been filed under Section 439 Cr.P.C. on behalf of accused-petitioner- Dilkhush against the impugned order dated 20.02.2023 and the accused-petitioner- Jai Singh against the impugned order dated 28.03.2023 passed by learned Court(s) below for the offence under Sections 147, 148, 149, 324, 325, 307, 323, 341 & 302 IPC in FIR No. 248/2021

registered at Police Station Malarna Doongar, District Sawai Madhopur.

Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case. The accusedpetitioners have nothing to do with the alleged offence. They are behind the bars since long time. It is specifically alleged that it was the accused- Chetram, who hit the deceased- Laddu with his Bolero vehicle and the other accused- Man Singh used his tractor in hitting the deceased. No specific role has been attributed to the present petitioners. The other similarly situated co-accused persons have already been enlarged on bail by the High Court. Trial of the case is likely to take a long time to conclude and till then, their further incarceration would not serve any fruitful purpose. They are ready and willing to furnish bail bonds for their release. Therefore, the bail applications deserve to be allowed.

Learned Public Prosecutor has vehemently opposed the bail applications.

Heard learned counsel for the parties and perused the material available on record.

Taking into consideration the submissions put forth and overall facts and circumstances of the case but without commenting upon detailed merits of the case, this Court deems it fit to enlarge the accused-petitioners on bail.

Therefore, the bail applications are allowed. Accusedpetitioners namely- Dilkhush S/o Ramlal & Jai Singh S/o Shri Manfool , shall be released on bail, if they are not required in any other case, provided each of them furnishes a personal bond in

the sum of Rs.50,000/- (Fifty Thousand) together with two sureties in the sum of Rs.25,000/- (Twenty-five Thousand) each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court and any other court to which the matter is transferred, on all subsequent dates of hearing and as and when they are called upon to do so.
