At the outset, learned counsel for the petitioner seeks permission to withdraw the bail application of petitioner No.1Chailu Singh.

The bail application of petitioner No.1 Chailu Singh is disposed of as withdrawn.

Heard learned counsel for the petitioner on the bail application of petitioner No.2-Jitendra Singh and petitioner No.3Bhopal Singh.

The petitioners have been arrested in connection with FIR No. 04/2023 of Police Station – Napasar, District Bikaner for the offences punishable under Sections 307, 323, 325, 341 and 143 of the IPC. They have preferred this bail application under Section 439 Cr.P.C.

Learned counsel for the petitioners have submitted that the petitioners have falsely been implicated in this present case. It is further submitted that as per the statements of injured, no injuries were caused by the present petitioner, which is dangerous to life and therefore no offence under Section 307 of the IPC is made out against the petitioners. The accused-petitioner s are in custody since long and the trial of the case will take long time. Therefore, the benefit of bail should be granted to the accusedpetitioners.

Learned Public Prosecutor as well as learned counsel for the complainant have vehemently opposed the bail application. 8) Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the accused petitioners under Section 439 Cr.P.C.

Accordingly, the bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioners - (1) Jitendra Singh S/o Raju Singh (2) Bhopal Singh S/o Gulab Singh

shall be released on bail in connection with FIR No. 04/2023 of Police Station – Napasar, District Bikaner, provided they execute a personal bond in a sum of Rs.1,00,000/- each with two sound and solvent sureties of Rs.50,000/- to the satisfaction of learned trial court for their appearance before that court on each and every
