This application for bail has been filed by the accusedpetitioner under Section 439 of the Cr.P.C. in connection with FIR No.0014/2023, registered at Police Station Kotwali Jhalawar, District Jhalawar for the offences under Sections 380 and 457 of IPC.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in the present case.

Learned counsel submitted that the Trial Court has dismissed the bail application of the accused-petitioner on the ground that criminal cases are pending against the accused-petitioner.

Learned counsel submitted that the accused-petitioner is in custody since 25.01.2023. Learned counsel further submitted that charge-sheet has been filed. Learned counsel argued that no custodial investigation is required to be done in this case.

Learned Public Prosecutor has opposed the misc. bail application and submitted that looking to the pendency of the criminal cases against the accused-petitioner, it would not be appropriate to give indulgence of bail to the accused-petitioner.

Having regard to the facts and circumstances of the case and looking to the fact that the charge-sheet has been filed and also considering the fact that the accused-petitioner is in judicial custody since 25.01.2023 and conclusion of trial will take long time, but without expressing any opinion on the merits of the case, this Court deems it just and proper to grant bail to the accused-petitioner under Section 439 Cr.P.C.

Consequently, the bail application filed under Section 439 Cr.P.C. is allowed. The accused-petitioner Madan Lal S/o Narayan arrested in connection with FIR No.0014/2023 registered at Police Station Kotwali Jhalawar, District Jhalawar, shall be released on bail on his furnishing personal bond in the sum of Rs.50,000/- and two sureties of Rs.25,000/- each, duly certified to the satisfaction of the Trial Court. Accused-petitioner shall be required to appear before that Court on all the dates of hearing and as and when called upon to do so.
