The petitioner has been arrested in connection with FIR No.45/2019 of Police Station Gida, District Barmer for the offences punishable under Sections 8/15, 25 & 29 of the NDPS Act and Sections 279 & 337 of IPC. He has preferred this third bail application under Section 439 Cr.P.C.
The petitioner’s father, present in person, makes pleadings and seeks sympathetical consideration of the bail application. He has also shown this Court the order dated 15.02.2022 passed in Thana Ram Vs. State of Rajasthan : S.B. Criminal Misc. Bail Application No.12042/2021 , in which, the co-accused Thana Ram has been granted bail by a coordinate Bench of this Hon’ble Court.
After hearing petitioner’s father present in person as well as perusing the material available on record, this Court is not inclined

to grant bail to the petitioner because the petitioner was caught at the site in question and the matter pertains to the recovery of NDPS substance, and thus, no cause of interference is made out. Accordingly, this third bail application filed under Section 439 Cr.P.C. is dismissed.
