The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 199/2019 registered at Police Station Sapotara District Karauli and charge-sheeted for the offence(s) under Sections 420, 467, 468, 471, 120-B of IPC.

Despite service, no one appeared on behalf of victim/complainant.

Heard learned counsel for the applicant and the learned Public Prosecutor.

Considering the arguments advanced by both the sides, considering that the matter is triable by magistrate; that charge-

sheet has been filed; that co-accused Anoop has been enlarged on bail vide order dated 06.10.2023 in S.B. CRLMB No. 11393/2023; that applicant, who is a young man aged about 28 years, has been in custody since 01.11.2023; that the applicant has been extended the benefit of anticipatory bail in the two out of three cases shown to be pending against him, and looking to the overall facts and circumstances of the case and material on record, but without commenting on merits/demerits of the case, this Court is inclined to allow the present bail application.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that accused-applicant Ajay S/o Shri Roopsingh shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
