Heard Mr. Shyamlal, the brother of petitioner-Baluram @ Balram and Learned GA-Cum-AAG for the State.

This Criminal Misc. 2^nd Bail Application has been brought under Section 439 of Cr.P.C. in connection with FIR No.103/2022 registered with Police Station Mandana, District Kota Rural for offences under Sections 341, 323, 34 and 307 of IPC.

According to FIR, at the spur of the moment, the incident of assault took place, wherein, the petitioner allegedly caused injury with a spade at the head of Bhanwarlal. The doctor has reported grievous injury at the parietal region of Bhanwarlal. The petitioner is in custody since 29.05.2022. The trial is already going on and the petitioner is ready to co-operate with the trial.

Learned Additional Advocate General for the State has opposed the prayer for bail.

Considering the nature of allegation which allegedly took place at the spur of the moment, the instant 2^nd bail application stands allowed.

It is directed that the above-named petitioner be released on bail in the aforesaid FIR if he is not wanted in any other case, provided that he furnishes a bail bond of Rs.25,000/- (Rupees Twenty-five Thousand only) with two sureties of like amount to the

satisfaction of the learned trial court with following conditions :- (i) the petitioner shall fully co-operate in the trial, failing which, the trial judge would be at liberty to cancel the bail bonds of the petitioner.

(ii) the petitioner shall not leave the Country without permission of the Court otherwise it would amount to disobedience of the order of this Court and would be a ground for cancellation of bail. (iii) the petitioner shall not tamper with the evidence.
