Petitioner has filed this miscellaneous bail application under Section 438 Cr.P.C.

F.I.R. No.682/2022 was registered at Police Station Aravali Vihar, District Alwar for offences under Sections 143, 323, 379, 354 & 427 of I.P.C.

It is contended by counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that sister of the petitioner is daughter-in-law of the complainant. Dispute arose when sister of the petitioner was maltreated by her in-laws and on the same day of lodging the FIR, father of the petitioner and complainant's son were arrested under Section 107, 116(3) & 151 Cr.P.C. He further submits that petitioner has joined the investigation in terms of order dated 12.04.2023 and custodial interrogation of the petitioner is not required in this matter.

Learned Public Prosecutor has opposed the bail application but fairly concedes that petitioner has joined the investigation.

I have considered the contentions.

Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for both the parties and the fact that there is matrimonial dispute between the parties and the petitioner has joined the investigation, but without expressing any opinion on merits/demerits of this case, this Court deems it just and proper to enlarge the petitioner on bail.

The anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Aravali Vihar, District Alwar in F.I.R. No.682/2022 is directed that in the event of arrest of the petitioner- Gaurav Sharma Son Of Shri Yash Kumar

Sharma, he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs. 25,000/- each to his satisfaction on the following conditions:-

(i). that the petitioner shall make himself available for interrogation by a police officer as and when required;

¶23

(ii). that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

¶24

(iii). that the petitioner shall not leave India without previous permission of the court.
