The present bail application has been filed by the petitioner under Section 439 Cr.P.C. in connection with FIR No.XV/ (7)5/Seij./JPR/2022 Registered at the office of the Central Bureau of Narcotics, Jaipur for the offence(s) under Sections 8/21C, 8/26 and 8/22C of the NDPS Act.

Due to abstain from judicial work, the advocates have not appeared in the court today. Ms. Aditi Tambi, who is power of attorney holder of petitioner-Dr. Anil Kumar Tambi is present in the court today and submits that the petitioner has been falsely implicated in this case. He is behind the bars for more than two and half months. She further submits that the petitioner is a medical practitioner. He was made an accused on the basis of

statement of co-accused Mohammad Vahid Qureshi. She also submits that as per notification of Government of India dated 28.03.2019, petitioner is authorized to supply the drugs and he had submitted all the records to the Investigating Officer. Conclusion of trial may take long time. Hence, the petitioner may be enlarged on bail.

She has placed reliance upon the following judgments:- (1) Dr. Shashi Bhushan Vs. State Of Haryana in Criminal Miscellaneous No.M-4643/2018 (O&M) decided on 25.09.2018 ; (2) Dr. Rajinder Singla Vs. State Of Punjab in Criminal Miscellaneous No.M-37530/2015 decided on 18.11.2015 & (3) Dr. Dharmendra Vs. UOI, through C.B.N., Chittorgarh in S. B. Criminal Miscellaneous Bail Application No.3042/2020 decided on 21.09.2021 .

Mr. Rajesh Shukla, Inspector, Central Bureau of Narcotics, Jaipur is present in the court today and submits that the petitioner had not submitted any record at the time of search. So, on account of gravity of offence, bail be dismissed. 5. Considering the contentions and taking into account the facts and circumstances of the case, without expressing any opinion on the merits and demerits of the case, this court deems it just and proper to enlarge the petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Dr. Anil Kumar Tambi S/o Late Shri Radheyshyam Tambi be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the
