Heard learned counsel for the parties and also perused the material on record.

The petitioner has been arrested in FIR/CR No.75/2020 of Police Station Deshnok, District Bikaner for the offences punishable under Sections 302 and 34 IPC. He has preferred this second bail application under Section 439 Cr.P.C.

Learned counsel for the petitioner has submitted that after rejection of first bail application of the petitioner, the statements of Doctor, who conducted the postmortem, and Garvit Jain have been recorded before the trial court as PW-1 and PW-2 respectively. It is submitted that from the statements of PW-1 Doctor as well as the postmortem report, it is clear that all the

injuries on the body of the deceased were stab wound and inflicted by a sharp weapon, whereas the police have recovered a lathi at the instance of the petitioner on which also no blood was found.

Learned counsel for the petitioner has invited my attention towards the statement of Garvit Jain (PW-2) and submitted that PW-2 in his court statements has not named the petitioner, who inflicted any injury upon the body of the deceased. It is also submitted that as per the list of witnesses, there are 36 prosecution witnesses, whereas out of those witnesses only 3 have been examined till date. It is further submitted that the petitioner is in custody from last more than two and half years and trial of the case will take time.

Learned Public Prosecutor as well as learned counsel for the complainant have opposed the bail application.

Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the accused petitioner under Section 439 Cr.P.C.

Accordingly, this second bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioner - Ravi @ Ravindra Singh S/o Shankardan shall be released on bail in connection with FIR/CR No.75/2020 of Police Station Deshnok, District Bikaner provided he executes a personal bond in a sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/each to the satisfaction of learned trial court for his appearance

before that court on each and every date of hearing and whenever
