The present interim bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner, who is in judicial custody in connection with Crime No.01/2021, CBN, Singoli for the offence under Section 8/15 of NDPS Act.

Heard representative of the petitioner and the learned Special P.P. present on behalf of the Union of India, CBN. Perused the material available on record.

The instant application has been filed on the ground that the wife of the applicant is suffering from serious ailment and the doctor has advised for operation and there is no other family member to look after her, therefore, the temporary bail application filed on behalf of the applicant may be allowed.

Considering the submissions and taking a humanitarian view of the matter, this Court is inclined to grant indulgence of temporary bail to the petitioner to enable him to look after his wife.

Accordingly, the instant interim bail application is allowed. The petitioner shall be released on bail for a period of 30 days from the date of his actual release provided he furnishes a personal bond in the sum of Rs. 1,00,000/- along with two sound and solvent sureties in the sum of Rs.50,000/- each to the satisfaction of concerned trial court. The order shall be effective from the date of the petitioner's release. The concerned jail authority shall give the date of surrender to the petitioner.

In view of the fact that Dipawali festive holidays are commencing from 10.11.2023 to 15.11.2023, it is deemed appropriate to direct that if the bail order produced before a duty magistrate/remand magistrate, he is expected to verify and attest the same.
