It is contended that after receiving certified copies of the judgment, much time had elapsed in different Government offices and obtaining the legal opinion, whereafter the file was sent to the Department of Law and Justice. The delay was not made deliberately, but the time has been taken at various steps and in different hands. It is contended that the meritorious matters should not be thrown away on the ground of technicalities. A glance over the judgment of acquittal would persuade the court to interfere in the finding.

Having considered the submissions advanced, the application under Section 5 of the Limitation Act is allowed and the delay in filing the leave to appeal is condoned. The same be treated within limitation.

On a perusal of the impugned judgment dated 02.08.2022, there appears valid and reasonable grounds to allow the petitioner to move an appeal against the same.

Accordingly, the instant leave to appeal application is allowed. The memo of leave to appeal application shall be treated and registered as an appeal.

A bailable warrant in the sum of Rs.25,000/- be issued against the respondent. Rule be made returnable on 11.12.2023.
