Appellants have preferred this appeal aggrieved by order dated 20.04.2023, whereby application filed by the appellants under Section 167(2) Cr.P.C. was dismissed.

It is contended by counsel for the appellants that the order dated 22.06.2022 was passed without affording opportunity of hearing to the appellants.

Learned counsel appearing for the NIA has contended that appeal filed against the order dated 22.06.2022 was not within the prescribed time and the appeal has been dismissed by this Court.

We have considered the contentions.

Since the appeal filed against the order dated 22.06.2022 stands dismissed by this Court, therefore, nothing survives in the present appeal and the same is also dismissed accordingly.
