Instant appeal is preferred aggrieved from order dated 16.09.1989 in criminal appeal 73/1985 passed by learned Additional Sessions Judge No.2, Ajmer whereby learned appellate court allowed the appeal filed by respondent accused and acquitted respondent under Section 406 IPC.
Even on last occasion, complainant was not present.
It appears that the complainant is not interested in pursuing this appeal, therefore, complainant remained absent since 16.04.2013.
Hence, the present appeal is dismissed for non-prosecution. Misc. application, if any, stands disposed of.
