The criminal appeal was dismissed as having become abated. The appellant, Ram Kunwar, expired on 19.09.2001, prior to the hearing of the appeal dated 01/09/2023. Upon receipt of the death certificate and subsequent report by the Public Prosecutor, the court allowed the abatement of the appeal under the statutory provisions governing abatement in criminal proceedings.
