The present restoration application has been preferred against the order dated 15.12.2022 whereby the revision petition as preferred by the petitioner was dismissed by the Deputy Registrar (Judicial) in pursuance to the peremptory order dated 21.10.2022.
It has been submitted in the application that inadvertently, wrong notices were filed and on 21.10.2022 when the matter was listed before the Court, the counsel could not appear and the peremptory order was passed. As the counsel did not appear on the said date, he was not aware of the fact that the order was a peremptory one therefore, the compliance of the order could not be made.
In view of the submissions made in the application, the restoration application is allowed. Let the revision petition be restored to its original number.
