The instant application for interim bail has been filed on behalf of the appellant Pawan Kumar on the ground that his wife has been advised to undergo surgical procedure of Hysterectomy.

Learned Public Prosecutor has placed on record the verification report received from the Police Station Hamirwas, District Churu as per which, the lady was got checked at the SMS Hospital, Jaipur. She has been advised Hysterectomy and surgery has been scheduled on 25.11.2022. There is no other adult male member who can take care of Smt. Poonam, wife of the appellant and make necessary arrangements required for her hospitalization etc.

Thus, taking a humanitarian view of the matter, we are inclined to grant interim bail and suspend the sentences awarded to the appellant for a period of thirty days from the date of his release so that he can make arrangements and stay besides his wife during the period of hospitalization and recuperation.

Accordingly, the instant application for temporary suspension of sentences is hereby allowed and it is directed that the sentences awarded to the applicant-appellant Pawan Kumar S/o Shri Rameshwar Lal shall remain suspended and he shall be released on temporary bail for a period of thirty days from the date of his release provided he furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties in the sum of Rs.50,000/each to the satisfaction of the trial court. The Superintendent, Central Jail, Bikaner shall give the date of surrender to the appellant as per the date on which he is released from custody. Needless to say that after completion of the aforesaid period, the applicant-appellant shall surrender before the concerned jail authorities.
