Learned counsel for the petitioner in the light of preliminary objection submits that he is ready to avail alternative remedy as available under clause 51 of the contract.
Looking to the said bonafide prayer made by petitioner, he is permitted to withdraw the writ petition for availing alternative remedy as available under clause 51. It is directed that if within a period of one month, the remedy is sought as provided under clause 51, limitation period will not come in the way of petitioners.
In the light of above, the writ petition is disposed of.
