The present petition (Public Interest Litigation) is being filed because of the violation of the Electricity Act in the area of Crusher Basti and Barda Basti, situated in Ward No.33 of Nagar

Nigam Kota (South), Anantpura Kota having a population of more than 20,000 residents.

It is submitted that the distribution system in the area in question is under seriously dilapidated condition and in gross violation of the Safety Regulations and Electricity Act which may lead to accidents causing human and property loss in the area in question. At several places the cables are even touching the residential buildings, which can lead to any unfortunate accident. It is also submitted that due to disputes between the two Departments i.e. JVVNL and Department of Forest, no maintenance is carried out, which may result in accident and loss of human life. On the query put up to the petitioner’s counsel that whether any representation has been filed, he conceded that the same is not made to the residential authorities/respondents.

In the present matter, we feel that the interest of justice will be met, if the petitioners are permitted to file a representation to the respondents No.1, 2 and 4 within a period of one month from the date of receipt of this order. The said representation will be duly considered by the said respondents within a period of three months in accordance with law and on consideration of case.

In the light of above directions, the writ petition (PIL) is disposed of.
