“29. It is thus submitted that non- medical teachers like the petitioner who do not possess the qualification of MBBS, for appointment to the Department of Biochemistry of any medical college in the Country, apart from other academic qualifications, must possess the qualification of M.Sc. & Ph.D. in Medical Biochemistry from a recognized medical college. 30. It is further submitted that subsequently, after receiving prior permission of the Central Govt. As per Section 33 of the Indian Medical Council Act, 1956, the Minimum Qualification for Teachers in Medical Institutions Regulations, 1998 have been further amended vide Notification dated 31.10.2018 which has been published in the Gazette of India on 01.11.2018, copy whereof is annexed herewith as AnnexureR-5/2. The aforesaid amended Minimum Qualification for Teachers in Medical Institutions Regulations, 1998, apart from other additions / modifications / deletions / substitutions as contained in the notification, for appointment to the post of Assistant Professor in the Department of Biochemistry of any medical college provides that a candidate must possess teaching experience of 3 years as a Junior Resident in a recognized / permitted medical college in the concerned subject and of 1 year as a Senior Resident also in a recognized / permitted medical college in the concerned subject.
