The present petition has been filed against the impugned order dated 17.08.2022 whereby the petitioner has been transferred from Hanumangarh to Jhunjhunu.
Learned counsel for the petitioner submitted that earlier vide order dated 03.06.2022, the petitioner was transferred from Nohar to Dholpur against which order a writ petition was preferred before this Court and vide interim order dated 09.06.2022, the said order was stayed. Subsequently, the order dated 03.06.2022 was withdrawn by the Department but now again vide the impugned order he has been sought to be transferred whereas he is due to retire on 31.07.2023. Learned counsel further submitted

that the present order has been passed just to overreach the earlier order which also was interfered by this Court on the premise that the person who is on verge of retirement cannot be transferred. He also submitted that as per his information there are seats vacant at Suratgarh, District Sriganganagar.
Learned counsel for the respondents candidly submitted that in the present circumstances, the Department is ready to consider and post the present petitioner at a place nearby to his present place of posting.
In view of the submissions made, the present petition is disposed of with the direction to the respondent-Department to pass a fresh order of posting of the petitioner preferably at Suratgarh in District Sriganganagar.
The said exercise be completed by the respondentauthorities within a period of two weeks from the date of the present order.
Stay petition also stands disposed of.
