The present Civil Transfer Appeal Petition under Section 24 of the CPC has been preferred by the petitioner-husband for transferring the Civil Case No.55/2017 filed by the respondentwife under Section 13 of the Hindu Marriage Act for transferring the same from the Court of ADJ Bhinmal, Jalore to the Court of DJ Balotra, District Barmer or at Jodhpur.

Learned counsel appearing for the petitioner submits that the respondent has preferred the divorce petition under Section 13 of the Hindu Marriage Act before the ADJ Court Bhimnal, District Jalore and the said Court is having no jurisdiction to decide the case as the petitioner is residing at Balotra.

Learned counsel appearing for the respondent at the outset submits that the petitioner has also preferred two criminal misc. petitions, viz, S.B. Criminal Misc. Transfer Petition No.14/2021 and

SB Criminal Misc. Transfer Petition No.13/2021 and this Court vide its order dated 28.03.2022 rejected both the transfer petitions.

Heard learned counsel for the parties and perused the material placed before this Court.

It is not in dispute that the two transfer petitions preferred by the petitioner for transferring the cases pending in the Courts at Bhinmal have already been rejected by this Court, therefore, the present transfer Petition also deserves to be dismissed.

Accordingly, the present Transfer petition is dismissed.
