The instant second appeal has been preferred by appellantsdefendants, assailing judgment and decree dated 22.11.2018 passed in appeal No.29/2018 by Additional District Judge, Chidawa, District Jhunjhunu whereby and whereunder civil suit was remanded to the trial Court for deciding afresh.

Counsel for appellants at bar submits that in compliance of judgment and decree dated 22.11.2018, the suit has finally been decided, therefore, the instant second appeal has become infructuous, as such he does not want to press the same.
