Heard.

The only scope of this petition is with regard to modification in the terms of parole granted vide order dated 05.03.2022 by the competent authority.

According to learned counsel for the petitioner, the family and financial condition of the petitioner who has already undergone more than nineteen years of jail sentence by now is such that she cannot furnish the sureties as directed, therefore, the same may be modified to the extent of personal bond only.

Learned State counsel would submit that appropriate direction/order may be passed taking into consideration the relevant circumstances of the case.

Having gone through the contents of the petition, further taking into consideration that the appellant has undergone more than nineteen years of jail sentence and other aspects of the matter particularly taking into consideration that in the past the petitioner was released on parole and there is no material to show that at any point of time, the condition of parole has been violated, we are inclined to modify the order dated 05.03.2022 in respect of petitioner-Parikshit Bharti in the manner that the petitioner shall be released on parole only on furnishing personal bond of Rs.50,000/-.

The requirement of sureties as directed under order dated 05.03.2022 are dispensed with. Accordingly, the parole writ petition is allowed.
