The instant petition has been filed under Section 482 Cr.P.C. for transfer of the investigation of FIR No.77/2022 registered at Police Station Batoda, District Sawaimadhopur for the offences under Sections 279 & 304-A IPC either to the CID(CB) or any other independent agency for conducting fair, impartial and speedy investigation.

Learned counsel for the petitioner-sister of deceased-Mahendra has submitted that the police has not conducted the investigation fairly and properly, hence, she prays that the investigation of this case may be transferred to the CID(CB) or any

other independent agency for conducting impartial, effective and speedy investigation.

Learned Public Prosecutor has submitted a factual report received from the concerned SHO disclosing therein that the investigation has been completed and the charge-sheet has also been filed in the concerned Court.

Having considered the submission of learned Public Prosecutor, nothing survives in this petition as charge-sheet has already been filed in this matter, therefore, this criminal misc. petition is accordingly dismissed.

Learned counsel for the petitioner has submitted that after filing of the charge-sheet, the petitioner has moved an application under Section 190 Cr.P.C. before the concerned Magistrate Court and prayed that appropriate directions may be given to the concerned Magistrate for deciding the said application expeditiously.

Learned Judicial Magistrate is directed to decide the aforesaid application as far as possible after giving opportunity of hearing to all concerned parties, in accordance with law.
