After arguing for some, learned counsel for the petitioner seeks permission to withdraw the present petition, however, with a limited indulgence that if the petitioner surrenders before the trial Court and files a bail application, the trial Court be directed to consider his bail application on the same day.

Normally, this Court would not have granted such indulgence to the petitioner but considering that the charge-sheet has been filed against the petitioner under section 299 Cr.P.C. and the petitioner is otherwise absconding, this Court deems it expedient to grant limited indulgence as prayed so that the case against the accused-petitioner can be proceeded with in accordance with law.

In the peculiar facts and circumstances of this case, the petitioner is directed to surrender before the trial Court on or before 25.11.2022.

In case petitioner surrenders before the trial Court and moves a bail application, the trial Court shall consider and decide the same, in accordance with law, on the same day. In case it cannot be decided on the same day, the trial Court shall decide the same within three working days of filing the same.

With these observations the misc. petition stands dismissed as withdrawn.

Stay petition also stands dismissed.
