On the basis of the factual report dated 07.09.2022, learned Public Prosecutor informs that no offence has been made out against petitioner No.2 – Hemlata and petitioner No.3 – Sunita while offences punishable under Sections 498A and 323 of the Indian Penal Code have been made out against the petitioner No.1 – Naresh S/o Murlidhar Mayani and accordingly, a charge-sheet has been filed.

Having heard learned Public Prosecutor and perused the report, this Court is not inclined to continue with the present petition.

The instant criminal miscellaneous petition so also stay petition stands disposed of accordingly.

The petitioner No.1 - Naresh shall be at liberty to take appropriate remedy including putting forth his defence at the time of framing charges.
