The present bail application has been filed under Section 438 Cr.P.C. in connection with FIR No.762/2021 registered at Police Station Kotputli, District Jaipur Rural for the offence(s) under Sections 420 & 406 of the I.P.C.

Learned counsel for the petitioner submits that the petitioner is ready and willing to abide by all such terms and conditions which will be imposed upon him by this Court.

Learned Public Prosecutor has vehemently opposed the bail application.

Heard learned counsel for the petitioner. Pursuant to the direction of this Court on 19.01.2022 the petitioner has joined the investigation and hence thoroughly been interrogated. It is not a case where custodial interrogation would be required. The case is irrefutably one where the provisions of Sections 41 and 41A of the

Cr.P.C. are applicable and the judgment passed by the Hon’ble Supreme Court in the case of Arnesh Kumar Vs. State of Bihar (2014) 8 SCC 273 is to be complied. Considering the contentions put-forth by the counsel for the petitioner and taking into account the totality of facts and circumstances of the case and without expressing any opinion on the merits of the case, this court deems it just and proper to allow the anticipatory bail application.

Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Kotputli, District Jaipur Rural in F.I.R. No. 762/2021 is directed that in the event of arrest of the petitioner -Naruram S/o Late Shri Godaram he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

¶22

(iii) that the petitioner shall not leave India without previous permission of the court.
