The present bail applications have been filed under Section 439 Cr.P.C. The petitioners have been arrested in connection with FIR No.83/2022, Police Station Osian, District Jodhpur Rural for the offences punishable under Sections 498A, 304B, 302 and 201 of the IPC.

Learned counsel for the petitioners submits that the present petitioners are mother-in-law and father-in-law of the deceased. Specific averment has been made against the husband of the deceased - Karna Ram. No specific averment has been made by the complainant against the present petitioners. Challan of the case has already been presented and no investigation is pending against the petitioners. The petitioners are in judicial custody and the trial of the case will take sufficiently long time. Therefore, the benefit of bail may be granted to the accused-petitioners.

Learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the prayer for bail and submits that all the three accused persons including present petitioners & husband of the deceased have murdered the deceased, therefore, the bail may not be granted to the accusedpetitioners.

I have considered the arguments advanced before me and gone through the material available on record.

Taking into account the facts and circumstances of the case and after going through the challan papers, no specific allegation has been made against the present petitioners and only omnibus allegations have been levelled against the petitioners, therefore, without commenting on the merits/demerits of the case, this Court deems it just and proper to release the petitioners on bail.

Accordingly, the bail applications under Section 439 Cr.P.C. are allowed and it is ordered that the accused-petitioners, (1) Kasumbi W/o Sh. Sona Ram, (Bail Application No.9818/2022) and (2) Sona Ram S/o Sh. Deepa Ram, (Bail Application

No.6521/2022) shall be enlarged on bail in FIR No.83/2022, Police Station Osian, District Jodhpur Rural provided each of them furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
