Learned counsel for the applicant has submitted that he does not want to press this criminal misc. bail application at this stage. However, he seeks liberty to file fresh bail application after recording statements of the witnesses Tilok Singh and Kailash.
Accordingly, this criminal misc. bail application preferred by the applicant under Section 439 Cr.P.C. is dismissed as not pressed at this stage.
At the request of learned counsel for the applicant, the trial court is directed to expedite the trial and record the statements of all eye-witnesses including Tilok Singh and Kailash on priority basis. Learned trial court is also directed to ensure the presence of the accused who are under custody from the concerned Jail.
