This bail application has been filed under Section 439 Cr.P.C in connection with FIR No.167/2021 registered at Police Station Nagarfort, District Tonk for the offences under Sections 341, 354 & 376/511 of IPC.

Learned counsel for the petitioner submits that a cross FIR bearing No.168/2021 has been lodged by the petitioner against the complainant and one another FIR bearing No.18/2022 has also been lodged by the wife of the petitioner against the complainant. Counsel further submits that the petitioner is behind the bars since 20.03.2022 and as per rejection bail order, he has no criminal antecedents. After investigation, charge-sheet has been filed against the petitioner for the offences under Sections 341, 342, 354 & 376/511 of IPC and the conclusion of the trial will take time. Hence, the petitioner may kindly be released on bail.

Considering the submissions made by learned counsel for the petitioner and taking into consideration overall facts and circumstances of the case but without expressing any opinion on the merits/demerits of the case, this court deems it just and proper to enlarge the petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the petitioner Prathviraj Son Of Durgalal shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
