The present bail application has been filed under Section 438 Cr.P.C. in connection with FIR No. 406/2021 registered at Police Station Mahila Police Station, District Alwar for the offence(s) under Sections 498A, 406 and 323 of IPC.

Learned counsel for the accused-applicants has submitted that vide order dated 04.04.2022, this court had granted interim protection to the accused-applicants who are the father-in-law and mother-in-law of the complainant. Learned counsel has further submitted that the marriage was solemnized on 20.10.2019, whereas, the alleged incident took place on 25.07.2020. Prior to the same, no case for Domestic Violence or Dowry was ever registered against the accused-applicants. Learned counsel has further submitted that in compliance of order dated 04.04.2022,

accused-applicants had joined the investigation. The matter was also sent for mediation but the same failed.

Per contra, learned Public Prosecutor and learned counsel for the complainant have opposed the bail application. 5. Considering the contentions put-forth by the counsel for the parties and considering the fact that interim order has been continued on various datesand that accused-applicant complied by conditional interim order by joining investigation, this court deems it appropriate to make the order dated 04.04.2022, absolute and allow the anticipatory bail application. 6. Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Mahila Police Station, District Alwar in F.I.R. No. 406/2021 is directed that in the event of arrest of the accused-applicants 1. Kulvinder Singh S/o Shri Mukhtyar Singh and 2. Smt Pervinder Kaur W/o Shri Kulvinder Singh , they shall be released on bail, provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

(iii) that the petitioner shall not leave India without previous permission of the court.
