The present bail application has been filed under Section 438 Cr.P.C. in connection with FIR No. 18/2009 registered at Police Station Anti Corruption Bureau, Jaipur District Jaipur for the offence(s) under Sections 13(1)(C)(D), 13(2) of PC Act and Section 409, 420, 467, 468, 471, 474, 477A, 201 and 120B of IPC.

Learned counsel for the accused-applicant has submitted that while working in the capacity of Sub-Divisional Officer, Kotputli, the accused-applicant had decreed a suit in 2007, for which the FIR came to be lodged in the year 2009, after a long lapse of time by the Anti Corruption Bureau. Learned counsel has further submitted that the accused-applicant has been superannuated yet the investigation agency at this stage, is trying to arrest him. Vide order dated 18.04.2022, interim protection from arrest was granted to the applicant subject to the condition that applicant joins investigation. In compliance of the same, the applicant joined investigation as directed.

Per contra, learned Public Prosecutor has opposed the bail application.

Considering the contentions put-forth by the counsel for the parties, considering that the matter is of 2009 and the order was passed in the capacity of Sub-Divisional Officer and considering the fact that interim order was granted on 18.04.2022 and that accusedapplicant complied with the conditional interim order by joining investigation and looking to the overall facts and circumstances of the case and material on record but without commenting up on the merits of the case, this court deems it appropriate to make the order dated 18.04.2022 absolute and allow the anticipatory bail application.

Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Anti Corruption Bureau, Jaipur District Jaipur in F.I.R. No. 18/2009 is directed that in the event of arrest of the accused-applicant Ramjilal Verma S/o Late Shri Ramsukhlal , he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

(iii) that the petitioner shall not leave India without previous permission of the court.
