The present bail application has been filed by the petitioner under Section 439 Cr.P.C. seeking interim bail on the ground of his ailment.
Learned counsel for the petitioner submits that the petitioner is suffering from HIV Positive problem and his condition is very critical. In these circumstances, the petitioner may be granted interim bail for a period of 30 days.
In pursuance of the order of this Court dt. 01.04.2022, learned Public Prosecutor has submitted a report of the concerned Police Station as well as of Medical Board, wherein it has been mentioned that at present, there is no complaint regarding his health and the petitioner is physically and mentally fit.
No case for grant of interim bail is made out.
Accordingly, the present interim bail application is hereby dismissed.
