The present bail application has been filed under Section 438 Cr.P.C. on behalf of the accused-petitioner in connection with FIR No. 511/2018 registered at Police Station Gandhi Nagar, District Jaipur City East for the offence(s) under Sections 420, 467, 468, 471 & 120B IPC.

Learned counsel for the accused-petitioner submits that the accused-petitioner has been falsely implicated in this case. The accused-petitioner has nothing to do with the alleged offences. The petitioner is a lady. There was a transactional dispute in between the parties. The purported agreement came to be executed in between the husband of the petitioner Ramswaroop and the complainant. The case is exclusively triable by the Court of Magistrate. Trial is likely to take long time to conclude.

Learned Public Prosecutor and learned counsel for the complainant-respondent have vehemently opposed the bail application.

Learned counsel for the complainant-respondent submits that they have been duped on two occasions and a false case has also been registered against them. It is also contended that the petitioner connived with her husband to prepare a false antedated certified document of marriage.

Considered the overall allegations leveled in the FIR and contentions made by the counsel for the accused-petitioner.

Taking into account the totality of facts and circumstances of the case and without expressing any opinion on the merits of the case, this court deems it just and proper to allow the anticipatory bail application filed on behalf of the accused-petitioner. 7. Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Gandhi Nagar, District Jaipur City East in F.I.R. No. 511/2018 is directed that in the event of arrest of the petitioner Smt. Santra Devi W/o Shri Ramswaroop D/o Shri Kanaram, she shall be released on bail, provided she furnishes a personal bond in the sum of Rs.50,000/with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case

so as to dissuade her from disclosing such facts to the court or any police officer, and (iii) that the petitioner shall not leave India without previous permission of the court.
