Learned counsel for the petitioners submits that the bail applications of co-accused-persons, namely Raisingh @ Vijay Singh and Rajkumar & Kamlesh vide order dated 04.01.2022, Ravi Kumar @ Ravi Paagdi, Dilkhush S/o Shri Ramkesh & Sanjay, Dilkhush S/o Shri Bharatlal, Shivdas @ Shiva, Yaduveer, Devendra, Paramveersingh & Jaiveersingh @ Deepak & Digambersingh @ Nehanu, Ravi Kumar, Mahendra Singh, Prathviraj @ P.R. and Umesh Kumar vide order dated 02.12.2021, Mahipal Singh Gurjar, Neeraj Kumar & Priyanka, Amit Kumar and Rajesh Kumar vide order dated 30.11.2021, Kamal Yadav vide order dated 20.11.2021, Seema Singh & Laxmi vide order dated 26.10.2021 and Usha & Manisha vide order dated 28.10.2021 have already been granted by the Hon’ble Court. Counsel further submits that the petitioners are behind the bars since long and charge-sheet has already been filed. Hence, the petitioners may kindly be released on bail.

Learned Special Public Prosecutor has strongly opposed the bail applications.

Considering the submissions made by learned counsel for the petitioners and taking into consideration overall facts and circumstances of the case but without expressing any opinion on the merits/demerits of the case, this court deems it just and proper to enlarge the petitioners on bail.

Accordingly, the bail applications under Section 439 Cr.P.C. are allowed and it is ordered that the petitioners, namely (i) Amrat Lal S/o Rameshwar, (ii) Ramlakhan S/o Badrilal, (iii) Bhajan Lal S/o Sanwantaram, (iv) Udaram S/o Jagram Bhishnoi, (v) Sohini Daughter of Shriram Wife of Raghunathram, (vi) Bhajanlal Son of Laduram, (vii) Savita Choudhary Daughter of Ramswaroop Choudhary Wife of Deepak Choudhary, (viii) Babluram S/o Ramdhan, (ix) Narendra Vishnoi S/o Premaram Vishnoi, (x) Nitesh Kumar Son of Jairam and (xi) Smt. Bharti Daughter of Gajanand Wife of Nitesh Kumar shall be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each (out of which one surety shall be the resident of Sawai Madhopur District for the petitioners Bhajan Lal S/o Sanwantaram, Udaram S/o Jagram, Sohini D/o Shriram W/o Raghunathram, Bhajanlal S/o Laduram, Babluram S/o Ramdhan and Narendra Vishnoi S/o Premaram Vishnoi) to the satisfaction of the learned trial judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
