The petitioners has been arrested in connection with FIR No.373/2022 of Police Station Chirawa, District Jhunjhunu, for the offences punishable under Sections 458, 460, 325, 342, 395, 397 of IPC (in S.B. S.B. Criminal Misc. Bail Application No.16520/2022).They have preferred these bail applications under Section 439 Cr.P.C.

Learned counsels for the petitioners submits that the similarly situated co-accused Nayum Khan has already been enlarged on bail and the case of present petitioners are not distinguishable from that of co-accused. The trial of the case will take sufficient long time to be concluded. Therefore, the benefit of bails should be granted to the accused-petitioners.

Learned Public Prosecutor opposed the bail applications.

Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to grant bails to the accused petitioners under Section 439 Cr.P.C.

Accordingly, the bail applications filed under Sec.439 Cr.P.C. are allowed and it is directed that petitioners (1) Sumer Singh @ Sonu S/o Richpal Singh & (2) Anil S/o Kishanlal, shall be released on bail in connection with FIR No.373/2022 of Police Station Chirawa, District Jhunjhunu provided they execute personal bonds in a sum of Rs.1,00,000/- each with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
