The instant bail applications have been filed by the petitioners (1) Deepak S/o Bhanwar Lal, (2) Manish S/o Shyam Lal & (3) Kamlesh S/o Omprakash under Section 439 Cr.P.C against the order impugned passed by learned court below in connection

with FIR No.816/2022, registered at Police Station Pratapnagar, District Bhilwara for the offences under Sections 341, 323, 325, 394 of IPC.

Learned counsel for the accused-petitioners submits that a false case has been foisted against the petitioners. The accusedpetitioners have nothing to do with the alleged offences. The case is exclusively triable by the court of Magistrate. Trial is likely to take long time to conclude. No fruitful purpose would be served by keeping the accused-petitioners behind the bars till disposal of the case. Therefore, the petitioners may be released on bail.

Per contra, learned Public Prosecutor opposed the bail application.

Heard. Considering the arguments advanced by the counsel for the parties and looking to the possibility that the trial may take long time to conclude, this court deems it just and proper to enlarge the petitioners on bail.

Accordingly, the bail applications under Section 439 Cr.P.C. are allowed and it is ordered that the accused-petitioners shall be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
