The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-applicant Ramsingh @ Dholu S/o Guganram. The applicant was arrested in connection with FIR No.02/2022 registered at Police Station Pacheri Kalan, District Jhunjhunu for the offence(s) under Sections 147, 148, 149, 302, 323, & 447 of IPC.

Learned counsel for the accused-applicant submits that the name of applicant is not reflected in the FIR. Co-accused persons named in the FIR and named in the charge-sheet are already enlarged on bail. The only allegation levelled against the applicant is recovery of the vehicle and no other allegation has been levelled against him in the charge-sheet. Trial will take time.

Per contra, learned Public Prosecutor and learned counsel for the complainant-respondent have vehemently opposed the bail

application and submitted that the case of the applicant is distinguishable from that of the other co-accused as recovery of vehicle, which was in the name of the applicant, has been done from him which is reflected in the charge-sheet. The offence committed by him is heinous in nature.

Heard the arguments advanced by the counsel for the parties and scanned the record. It is observed that in the case in hand, the co-accused has been enlarged on bail by Coordinate Bench of this Court vide order dated 19.07.2022. The applicant’s name was not reflected in the FIR.

Considering the arguments advanced by the counsel for the parties and looking to the overall facts and circumstances of the case and material on record but without commenting on merits and de-merits of the case, this court deems it appropriate to enlarge the applicant on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that accused-petitioner Ramsingh @ Dholu S/o Guganram shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
