The present bail applications have been filed under Section 439 Cr.P.C. on behalf of the accused-petitioners Vinod Kumar Saini S/o Shri Ramnath Saini & Sonu Meena Son Of Shri Seshmal Meena. The accused-petitioners have been arrested in connection with FIR No. 397/2021 registered at Police Station Vishwakarma,

District Jaipur for the offence(s) under Sections 323, 341 & 143 IPC.

Learned counsel for the accused-petitioners submits that a false case has been foisted against the petitioners. He further submits that the petitioners have nothing to do with the alleged offences. They are behind the bars since long and conclusion of trial may take long time.

Learned Public Prosecutor and learned counsel for the complainant-respondent have opposed the bail applications. 4. Heard learned counsel for the petitioner, learned counsel for the complainant-respondent and learned Public Prosecutor. Perused the challan papers. The entire incident had been captured in a CCTV Camera and the agency collected the footage. As per the memo of identification of seizure of CCTV footage and photographs, the accused persons namely Irshad Ali, Karan Nayak, Shahajad Ali, Sanny Sharma and Kamal Singh Jadaun were seen thrashing the deceased. Although, the presence of the petitioners Sonu Meena and Vinod Kumar Saini is also shown there.

A perusal of the statement of the prosecution witness, Ashok, recorded under Section 161 Cr.P.C. clarifies that no active role has been played by the petitioners Sonu Meena and Vinod Kumar Saini. Thus, looking to the overall facts and circumstances of the case and without commenting on the merits, this Court deems it just and proper to enlarge the petitioners on bail.

Accordingly, the bail applications under Section 439 Cr.P.C. are allowed and it is ordered that the accused-petitioners named above shall be enlarged on bail provided each of them furnishes a

personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
