In wake of instant surge in COVID-19 cases and spread of its highly infectious Omicron variant, lawyers have been advised to refrain from coming to the Courts.

The petitioner has preferred this misc. application claiming the following reliefs:

“It is therefore most humbly and respectfully prayed that this misc. application may kindly be allowed and modification of the order dated 05.07.2021, the convict prisoner Jitendra Singh S/o Shri Kesar Singh, At present lodged in Central Jail, Jodhpur may kindly be released on 1^st 20 days parole on furnishing personal bond in a sum of Rs.50,000/- only to the satisfaction of the

Superintendent Central Jail, Jodhpur from the actual date of release.

Any other relief which this Hon’ble Court deems fit in favour of the petitioner may kindly be granted.”

Learned counsel for the petitioner submits that this Court, vide order dated 05.07.2021, has granted first parole of 20 days to the petitioner. Learned counsel further submits that the petitioner is belonging to poor strata and his financial condition is very pathetic.

Learned counsel for the petitioner thus, submits that the condition of furnishing two sureties of Rs.25,000/- each imposed by this Court vide order dated 05.07.2021 may be waived and the petitioner-prisoner may be ordered to be released on first parole for a period of 20 days upon his furnishing a personal bond in a sum of Rs.50,000/- only, to the satisfaction of the Superintendent, Central Jail, Jodhpur from the actual date of his release.

Having regard to the overall facts and circumstances of the case, this Court is of the opinion that the convict - prisoner can be released on first parole for a period of 20 days in pursuance of the aforementioned order dated 5.07.2021 upon his furnishing a personal bond only, while the condition of furnishing of two sureties can be waived.

Accordingly, this misc. application is allowed, and while modifying the aforementioned order dated 05.07.2021 passed by this Court, it is directed that the convict – Jitendra Singh S/o Sh. Kesar Singh , who is presently lodged in Central Jail, Jodhpur shall be released on first parole for a period of 20 days in pursuance of the aforementioned order dated 05.07.2021 upon his furnishing a personal bond in a sum of Rs.50,000/- only, to the satisfaction of the Superintendent, Central Jail, Jodhpur.

The convict – Jitendra Singh S/o Sh. Kesar Singh shall surrender himself before the Superintendent, Central Jail, Jodhpur immediately after availing 20 days' parole from the date of his actual release.
