The instant appeal has been filed under Section 14A SC/ST (Prevention of Atrocities) Act on behalf of the appellants, who are in custody in connection with FIR No. 120/2022, Police Station Badi, District Dholpur, for the offences under Sections 143, 332, 353, 506 & 504 of IPC and Sections 3(1)(r), 3(1)(s) & 3(2)(va) of the SC/ST (Prevention of Atrocities) Act.

Heard learned counsel for the appellants and learned counsel for the complainant and learned GA-cum-AAG and learned Public Prosecutor. Perused the material available on record.

It is submitted by learned counsel for the appellants that they have been falsely implicated in this case. They are behind the bars since their arrest. They have nothing to do with the alleged offences, thus, their incarceration would not serve any fruitful purpose, therefore, benefit of bail may be granted to the appellants.

Per contra, learned GA-cum-AAG, learned Public Prosecutor and learned counsel for the complainant-respondent have vehemently opposed the bail application.

Having regard to the totality of facts and circumstances as available on record and upon a consideration of the arguments

advanced, this Court of the opinion that the appellants deserve to be enlarged on bail.

Consequently, the instant appeals are allowed. The impugned order dated 22.04.2022 passed by the Special Judge, SC/ST (Prevention of Atrocities) Cases, Dholpur in Criminal Misc. Case No. 47/2022 is set aside. It is ordered that the accusedappellants - Sameed Khan @ Sameer Khan S/o Sikander Khan, Sachin S/o Suresh, Aakash Yadav S/o Mukesh Yadav & Bhola Alias Ajay S/o Prem Singh arrested in connection with aforesaid FIR , shall be released on bail, if not wanted in any other case, provided each of them furnish a personal bond of Rs. 50,000/- and two sureties of Rs. 25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do
