The matter has come up on an application filed by the appellant under Section 151 of the CPC stating therein that the case has been settled by the parties in the spirit of Lok Adalat and, therefore, the appellant may be permitted to withdraw the present civil first appeal.
For the reasons stated, the application under Section 151 of the CPC for withdrawal of the first appeal and seeking direction for refund of Court fee, is allowed.
The present Civil First Appeal is disposed of as withdrawn and Registry is directed to refund the Court fee to the appellant.
