Heard learned counsel for the appellant.

Learned counsel for the appellant has agitated the grievance with respect to the non-consideration of the candidature of the appellant in pursuance of the order passed by the State Government dated 11^th February, 2021 which is placed on record as Annexure-12. He seeks liberty to pursue the remedy available

to the appellant for grant of promotion in accordance with the Annexure-12 dated 11^th February, 2021.

It is also noticed that the order impugned in the writ petition was passed only on 15^th December, 2020 (Annexure-11) and there was no challenge to the order dated 11^th February, 2021(Anenxure-12). The appellant could not have challenged the validity of the order dated 11^th February, 2021, as the order impugned was already passed on 15^th December, 2020, that is prior to the date of passing of order Annexure -12.

We have also perused the order dated 25.02.2021 passed by the learned Single Judge. The order dated 25.02.2021 does not suffer from any infirmity and the same is therefore upheld.

Therefore, the present appeal is dismissed with the liberty said above.
