Learned counsel for the appellant - Ramesh Kumar has submitted that he would be satisfied with the direction that the Superintendent Engineer, before whom, appeal preferred by the appellant is pending consideration, shall decide the same on its own merit without being influenced by any observation made by the learned Single Judge in the impugned order dated 23.07.2019 passed by in S.B. Civil Writ Petition Nos.10699/2019 and 7259/2019.
Learned counsel Mr. Sunil Beniwal, AAG appearing for the respondent – State and Mr. BS Sandhu appearing for private respondent – Ram Prakash have no objection if the present appeals are disposed of with a direction to the Superintendent Engineer concerned as prayed by Mr. RDSS Kharlia, learned counsel for the appellant.
In view of the above, these special appeals are disposed of with a direction to the Superintendent Engineer concerned to decide the appeal preferred by the appellant - Ramesh Kumar strictly on its own merit without being influenced by any observation made by the learned Single Judge in the impugned order dated 23.07.2019 in the above-referred writ petitions, expeditiously, preferably within a period of two months from the date of production of certified copy of this order.
