Learned counsel for the petitioners has approached this Court complaining that encroachment has been done in the village. They come with the complaint against the Tehsildar and Collector on the ground that the Sarpanch stated that an encroachment has been made but the Superior Authorities do not accept his contention.

In the opinion of this Court, such an approach adopted by the petitioner is wholly misconceived. If at all there is a grievance relating to encroachment, which is affected to any person, or the villagers at large, the remedy is available under the provisions of Rajasthan Land Revenue Act, 1956 and this Court in writ jurisdiction would be unable to decide the question relating to the facts.

In view thereof, the writ petition is misconceived and is accordingly dismissed.
