This writ petition has been filed on behalf of the petitioner with the following prayers:

“It is, therefore, most humbly and respectfully prayed that this writ petition may kindly be allowed and by an appropriate writ, order or direction:

(i) the impugned order dated 23.10.2020 (Ann.5) passed by respondent no.4 and administrative and financial sanction dated 10.05.2021 (Ann.8) passed by respondent no.2 may kindly be declared highly illegal, arbitrary, unjust, therefore, same may kindly be quashed and set aside.

(ii) The respondents may kindly be restrained from constructing the building of Gram Panchayat, PhulasarChhota in Chak 3 C.W.B. Square No.87/53 Killa No.6, 7, 8, 12, 13.

(iii) The respodents may kindly be directed to allot the 5 bighas land for construction of Gram Panchayat Building in gairmumkinabadi land of Square No.66/64, 86/8, 87/1, 67/57.

(iv) Any other appropriate writ, order or direction which this Hon’ble court deems just and proper may kindly be passed in favour of the petitioner.”

After hearing learned counsel for the petitioner and after going through the averments made in the writ petition, it appears that the dispute raised by the petitioner is regarding allotment of land for the construction of Gram Panchayat Bhawan of Gram Panchayat Phulasar Chhhota Panchayat Samiti, Bajju District Bikaner.

This Court is of the opinion that the allotment of land for the construction of a public utility building in a Gram Panchayat is an administrative matter and the administrative authorities are well equipped to resolve any dispute regarding the subject matter.

Learned counsel for the petitioner has submitted that the petitioner along with other villagers has already filed

representation before the District Collector, Bikaner raising their grievances regarding the allotment of land for the purpose of construction of Gram Panchayat Bhawan. It is also submitted that the District Collector, Bikaner has not taken any decision on the said representation of the villagers till date.

In such circumstances, I deem it appropriate to dispose of this writ petition with liberty to the petitioner to file a fresh representation before the District Collector, Bikaner for ventilating his grievances regarding allotment of the land for the construction of the Panchayat Bhawan of the Gram Panchayat concerned. It is expected that if any such representation is filed on behalf of the petitioner, the District Collector, Bikaner shall decide the same strictly in accordance with law within a period of 15 days from the date of filing of the said representation.

Ordered accordingly. Stay petition also stands disposed of.
