The controversy involved in the present bunch of writ petitions enlisted in the appended Schedule, which shall be treated to be part and parcel of the judgment instant, relates to the legality and propriety of engaging petitioners through placement agencies.

Brief facts for the present purposes are that the State Government promulgated Mukhyamantri Nishulk Dawa Yojana and Mukhyamntri Nishulk Janch Yoajana schemes to provide free medical health services to the patients visiting health centres. For the purposes aforesaid, autonomous institutions were also established to procure and supply the medicines and other requirements of the hospitals including items related to the health care in the State.

The petitioners herein were duly selected and appointed on various posts under respective schemes: (1) Mukhyamantri Nishulk Janch Yojana and (2) Mukhyamantri Nishulk Dava Yojana. Thereafter, the respondents initiated fresh selection process for appointment of Data Entry Operator/Computer Operator, Lab Assistant, Ward Boy, Pharmacist, Helper, Lab Technician etc. through Rajasthan Medicare Relief Society (RMRS) in the year 2016, providing for essential qualification as well as salary.

Petitioners were appointed in pursuance of the said selection process and agreements were executed between the petitioners and the Secretary of RMRS.

Petitioners have preferred these petitions with a grievance that regardless of various orders passed by this Court, directing the respondent – State to continue the engagement of contractual employees like petitioners as Data Entry Operator/Computer Operator, Lab Assistant, Ward Boy, Pharmacist, Helper, Lab Technician etc., directly or through Rajasthan Medicare Relief Society, the respondents are yet again making attempt to engage them through the placement agencies.

Learned counsel for the petitioners invited Court’s attention towards the order dated 20.03.2017, passed by this Court in S.B. Civil Writ Petition No.953/2017 ( Pankaj Kumar Upadhyay Vs. State of Rajasthan & Ors. ) and pointed out that while making observations against the respondents, this Court had directed the State to continue the petitioners and other similarly situated employees on contract basis, without invervention of third party agency or the placement agency.

Operative portion of the order dated 20.03.2017, rendered in Pankaj Kumar Upadhyay’s case (supra) reads thus:

"In a similar set of circumstances, the learned Single Bench of this Court in the case of Rajesh Kasara Son of Shri Goverdhan Lal Kasara Vs. State of Rajasthan (S.B. Civil Writ Petition No.5231/2013), decided on 02.09.2016 while dealing with almost identical issues and having placed reliance on the judgment rendered in the case of Mooli Devi Chouchary (supra) allowed the writ petition and held in no uncertain terms that:

“ the action of the State authorities in attempting to convert and alter the status of the petitioners from direct contractual employees under the District Collector, Pratapgarh to employees engaged through a firm or a placement agency cannot be approved as being grossly illegal and unconstitutional.”

Moreover, the circulars dated 01.05.2014 and 01.07.2015 of the Finance Department were already in existence at the time of the passing of the judgment rendered by learned Single Bench in the case of Rajesh Kasara (supra) on 02.09.2016.

In view of the above, the present petitions deserve to be allowed. The impugned orders dated 16.12.2016 and 21.12.2016 are set aside qua the petitioners, vide which they are being sought to be replaced or their services are being extended only upon being engaged through placement agency. The respondents shall continue to utilize the services of the petitioners as Computer Operators with machine on contractual basis and shall not replace them by another set of contractual employees either through direct appointment or placement agency. The services of the petitioners shall be renewed periodically till requirement of the services subsists and their services are found to be satisfactory or till the regular appointments are made.”

The judgment dated 09.01.2018, passed by the Division Bench of this Court in D.B. Spl. Appeal Writ No.935/2017 ( The State of Raj. & Ors. Vs. Amarchand Banjara ) was also placed for consideration of the Court to apprise that State’s challenge against the above referred judgment passed by the learned Single Judge

has failed and even SLP filed thereagainst by the State has also been dismissed by Hon’ble the Supreme Court, vide its judgment dated 05.10.2018 (Re: Diary No.31528/2018).

Mr. Shreekant Verma, learned counsel for the petitioners argued that the State’s action of engaging the petitioners and other similarly situated persons through placement agencies; issuance of notice dated 03.06.2020 and floating tenders for engaging placement agencies in various Districts, is illegal, arbitrary and contrary to the adjudication made by this Court.

Dr. Nikhil Jain, learned counsel, appearing in some of the writ petitions, invited Court’s attention towards an order/circular issued by the Director, Medical & Health Services on 02.09.2020 and submitted that when the State itself has taken an in-principle decision to do away with the placement agencies and engage Data Entry Operator/Computer Operator, Lab Assistant, Ward Boy, Pharmacist, Helper, Lab Technician etc. through Rajasthan Medicare Relief Society, the advertisements issued by the Chief Medical & Health Officer of Districts are liable to be declared illegal and quashed.

Mr. Shreyansh Mehta, associate to Mr. K.S. Rajpurohit, learned Additional Advocate General, appearing for the respondents, relied upon the Division Bench judgment dated 14.08.2015, passed in the case of The State of Rajasthan & Ors. Vs. Vipul Goswami (D.B. Special Appeal (Writ) No.647/2015) and submitted that State cannot be restrained from engaging workforce/employees through placement agencies.

He, nevertheless, admitted the fact that the State has decided to engage the services of the petitioners and like persons

In considered opinion of this Court, the concern shown rather grievance raised by the petitioners is genuine and the State’s action/attempt of deploying placement agencies as intermediary agencies between the petitioners and the State Government, is arbitrary, as has already been held by this Court.

That apart, when the State itself has come up with an order dated 02.09.2020, doing away with the placement agencies and rightly so, the proceedings of engaging placement agencies, cannot be countenanced. The same are liable to be declared illegal.

Petitioners are working as Data Entry Operator/Computer Operator, Lab Assistant, Ward Boy, Pharmacist, Helper, Lab Technician etc. on purely contract basis with the respondent society, namely RMRS. Introduction of placement agency would result in change in petitioners’ employer.

All the writ petitions are hereby allowed.

The advertisements/E-tenders issued by the respondents for engaging the petitioners through placement agencies impugned herein are hereby quashed.

The State – respondents are hereby directed to continue the petitioners engagement/contract with Rajasthan Medicare Relief Society, in accordance with law.

Needless to observe that in case regularly selected candidates are available, the State shall be free to proceed in accordance with law, including disbanding petitioners’ contract or disengaging them.
