Ms. Swati, learned counsel for the petitioner submits that the issue involved in the present writ petition is squarely covered by a decision dated 08.07.2020 passed by Jaipur Bench of this Court in bunch of cases led by SBCWP No.5798/2020 (Sampat Pashudhan Sahayak Prashikshan Sansthan Vs. State of Rajsthan & Ors .

In the case of Sampat Pashudhan Sahayak Prashikshan Sansthan (supra), this Court has observed thus :-

“Be that as it may, since this Court has already allowed the applications to be moved for grant of NOC and interim orders have been passed by this Bench as well as at Principal Seat.

Therefore, instead of asking each and every institutes to approach this Court, the State Government is directed to allow all the institutes, which are intending to start the said Courses for applying NOC by issuing a general advertisement and cut off date may be laid down therein. Such advertisement would also mention other conditions which the State Government may lay down for the purpose of grant of NOC as well as for starting of the Courses. The conditions of the policy may also be mentioned, if so required. Those petitioners, who have already moved the applications, need not file fresh applications for the said purpose. Those petitioners, who are before this Court and in those cases where there is no interim order, shall also be allowed to submit their applications by 20^th July, 2020.

Learned counsel appearing for the petitioners submit that if a decision is taken by the State Government not to further proceed for grant of NOC, then the fees which they have already deposited alongwith their applications may be refunded to them. In this regard, the Additional Advocate General submits that there should be no difficulty if a decision is taken not to proceed with the applications. It is further made clear that if any institute is aggrieved of decision to refuse NOC or renewal, it shall be free to approach this court afresh.

With the aforesaid observations, all these writ petitions stand disposed of. All pending applications also stand disposed of. ”

Mr. Gaur, learned AAG, is not in a position to dispute the aforesaid position of facts and law.

The present writ petition stands disposed of in terms of the above referred order passed in Sampat Pashudhan Sahayak Prashikshan Sansthan’s case (supra).

Stay application also stands disposed of accordingly.
