Applications have been filed by petitioners No. 1, 2, 3, 5 and respondents No. 8 and 9 seeking withdrawal of the writ petition based on compromise arrived at between the parties.

The application dated 02.08.2021 was signed by the parties and besides seeking withdrawal of the writ petition, a prayer was made that last paragraph of the order dated 12.12.2012 passed by the Revenue Board (Annex.-8) be deleted. However, the application was not supported by affidavit.

On directions of the Court, the respondents No. 8 and 9 – Dr. Arpana Kishoriya and Dr. Naveen Kishoriya have filed affidavits regarding withdrawal of the writ petition based on the compromise arrived at between the parties.

Whereafter, the petitioners No. 1, 2, 3 and 5 have filed fresh application with a limited prayer seeking withdrawal of the writ petition only. The said application is supported by affidavits of the petitioners No. 1, 2, 3 and 5.

It is indicated by learned counsel for the petitioners that the petitioner No. 4 – Smt. Manju Jalani has died during the pendency of the writ petition.

In view of the submissions made in the applications seeking withdrawal of the writ petition, supported by affidavits of all the concerned parties, the same are allowed only to the extent of withdrawal of the writ petition based on the compromise arrived at between the parties.

The prayer made in the application dated 02.08.2021 regarding deletion of last paragraph in the order dated 12.12.2012 (Annex.-8), is rejected.

Accordingly, the writ petition stands dismissed as withdrawn.
