In wake of second surge in the COVID-19 cases, abundant caution is being maintained, while hearing the matters in Court, for the safety of all concerned.
Learned counsel for the respondent makes a categorical statement at Bar that the writ petition is against the order passed in the application under Order 6 Rule 17 of CPC whereas the suit has been finally decided.
On such statement, the present petition is dismissed as having become infructuous. The petitioner shall be at liberty to take up all his issues at the time of filing the appeal, if so advised.
All pending applications also stand dismissed accordingly.
